| Our military client was charged in Placer County with misdemeanor reckless driving and had a clean misdemeanor record other than this charge. The DA was unwilling to reduce his charge to an infraction, so we set the matter for jury trial. At the conference just before calling the jurors, the attorneys described their theories of the case to the judge, and over the objection of the DA, the judge favored our theory and dismissed the reckless driving case against the client, and with his approval, found him guilty only of crossing the double yellow line, a one point DMV infraction. This prevented our client from getting a misdemeanor charge on his record. It also saved him onepoint on his DMV record, an insurance increase, and thousands in fines. |
